Judge

Between 2006 and 2022 Justice McNeill was a judge of the Courts of Appeal of Guernsey and Jersey in the Channel Islands, since 2015 as the Senior Judge. This work was wide-ranging, but particularly associated with the development of the law of trusts, with international issues and with administrative law. Notable judgments dealt with the restatement of customary property law, novel issues regarding sovereign immunity, reverse international equitable tracing, international aspects of the law of trusts and with multi-jurisdictional corporate insolvency and trusteeship. Justice McNeill was the lead judge of appeal working with teams creating the move towards electronic court systems and has regularly sat in fully electronic hearings with highly powered document management systems for sizeable international cases. As Senior Judge, Justice McNeill was closely involved in the revision and application of internal procedures, in particular the creation of new systems for judicial appointments which lay emphasis on transparency, objectivity and competency.
