    This Consultation Paper aims to explain the approach and model used for ADGM’s proposed regulations governing arbitration of disputes within ADGM and the recognition and enforcement of arbitral awards in the ADGM Courts. The Paper notes that the starting point for the Arbitration Regulations is the widely recognised global standard for arbitration regulation, the Model Law on International Commercial Arbitration published by the United Nations Commission on International Trade Law, known as the UNCITRAL Model. This Consultation Paper also draws attention to the series of modifications and enhancements proposed by ADGM in order to maximise party autonomy and control over the arbitral process and to accommodate the unique nature of ADGM’s jurisdictional and legal framework.

    This Consultation Paper introduces the regulations governing and setting out the scope of ADGM’s judiciary and the ADGM Courts, to be known as the ADGM Courts, Civil Evidence, Judgments, Enforcement and Judicial Appointments Regulations. In addition, the Paper introduces three sets of rules concerning the jurisdiction of the Court of First Instance, the enforcement of the ADGM Courts’ judgments, and measures to ensure the safety and security of persons in the ADGM Courts. The Paper explains that the regulations and rules are modelled principally on English statutes and subordinate legislation, with some provisions being drawn from Scots and Australian federal law. It also highlights how those statutes and laws from common law jurisdictions have been tailored specifically to the ADGM Courts’ requirements.

    This Consultation Paper aims to determine whether there is a need for a set of standalone data protection regulations in ADGM, as an alternative to the individual provisions currently legislating for some level of data protection in the Employment Regulations 2015. In this regard, we considered EU legislation as the most appropriate basis for preparing the draft standalone Regulations, and it is therefore the current EU Data Protection Directive 95/46/EC (the EU Directive) on which the Regulations are based. Broadly speaking, this imposes standards on the collection, use and distribution of individual personal data to be met by those entities in control of such data.
