ADGM Courts: 16 May 2016
16 May 2016, Abu Dhabi, UAE: The United Arab Emirates Ministry of Justice and Abu Dhabi Global Market Courts (ADGM Courts) today signed a Memorandum of Understanding (MoU) concerning a wide range of legal and judicial matters. In particular, they have agreed to take all necessary measures to ensure the enforcement of ADGM Courts’ judgments and ADGM arbitral awards before the Federal Courts in the UAE without examining the substance of the dispute.
The MoU is an important step that further fosters and develops the relationship between the UAE Ministry of Justice and ADGM Courts for the enduring benefit of the UAE. The collaboration will continue to maintain the integrity of and greatly increase the widely held confidence in the judicial systems of the UAE. This, in turn, will assist organisations operating in ADGM or choosing ADGM as the jurisdiction by any party, locally or internationally, to settle disputes.
The MoU also covers areas such as exchanging information and research in the fields of electronic services and information technology to enhance the efficiency of the respective judicial systems; and developing program initiatives for community awareness and education regarding legal and judicial concepts, particularly in relation to transparency and integrity of the systems.
The MOU was signed by His Excellency, Mohamad Hamad Al Badi Al Dhaheri, Undersecretary of the UAE Ministry of Justice, H.E Ahmed Al Sayegh, Chairman of Abu Dhabi Global Market and Lord David Hope, Chief Justice of ADGM Courts. His Excellency, Sultan bin Saeed Al Badi, Minister of Justice for the UAE was also present to witness the signing.
H.E. Mohammed bin Hamad Al Badi, Undersecretary of the Ministry of Justice has confirmed after the signing of the memorandum on the importance of joint coordination and exchange of experiences and knowledge between the ministry and the State’s government and private institutions to achieve complete justice concepts and ensure the supremacy of the law and the delivery of services provided by the judicial authority in the State, starting from the ministry's vision and strategic goals, particularly in terms of entering into judicial and legal partnerships that benefit the legal community in the State.
His Excellency praised the role of Abu Dhabi Global Market in achieving these concepts, due to its globally recognised expertise and capabilities. He added that the objectives of the memorandum extend to the exchange of information and research in the judicial, legal, academic and technical fields, and develop the capacity and the skills and expertise of the judges and their assistants, and the establishment of a strategic partnership to promote understanding and community awareness, pointing out that the memorandum also aims to develop and implement a clear and effective procedures for the recognition of judgments issued by the ADGM Courts and enforcing them within the jurisdiction of the Ministry, as well as making and developing of guidelines and protocols between the two parties, and the innovation and development of initiatives for programs of cultural awareness of the community that relate to the legal and judicial concepts for each of the two judicial systems.
Chief Justice of ADGM Courts, Lord Hope, commented: “The relationship that has been formed with the UAE Ministry of Justice through this MoU is of tremendous significance to ADGM Courts. The MoU records the strong and enduring commitment of the Ministry and ADGM Courts to work together to strengthen the community’s confidence in the UAE judicial system, particularly by providing accessible and outstanding service to all litigants and by bolstering judicial cooperation at local, federal, regional and international levels.
He added: “I am very grateful to the Ministry for their support of ADGM Courts. By drawing upon our respective capabilities, skills and experience and coupled with our mutual trust and respect, I have no doubt that we will achieve our agreed objectives according to our shared values, which include justice and equality, integrity and transparency, innovation and excellence and certainty in the overall legal environment and framework of the UAE .”
